Ohio Supreme Court Argument – Partner Bryan Penvose

Koblentz, Penvose & Froning, LLC Partner Bryan Penvose argued before the Ohio Supreme Court today arguing that the appropriate sanction for a violation of the Ohio Rules of Professional Conduct would be the jointly recommended public reprimand.

The oral argument was necessitated based upon the deviation of the jointly recommended sanction (by Bryan Penvose and the Columbus Bar Association) by the Ohio Board of Professional Conduct which recommended that a one (1) year suspension with six (6) month’s stayed would be the appropriate result.

Bryan argued that based upon the mitigation engaged in by his client, there was insufficient evidence for the Board of Professional Conduct to increase the sanction in their report and recommendation by “two (2) levels” to an actual suspension.

The Ohio Supreme Court Justices engaged in a lively discussion with Bryan and a representative from the Columbus Bar Association regarding the disciplinary matter and will levy their decision after further review of the record.
